Terms and Conditions

Welcome to PermitPhilly.com.  Permit Philly LLC and/or its affiliates (“us” or “Permit Philly” or “Permit Philly” or “PP”) provide website features and other Products and Services to you (the “user” or “you”).  These services encompass, but are not limited to, advice and communication regarding the permitting process in Philadelphia, and the provision of quotes for a given permit application and/or appeal case (your “case”).  When you agree, through communication within or without this website, to pay Permit Philly to work on your case, you are considered for the purposes of this document to have “retained Permit Philly,” or to have purchased the “retention of PP.”The referenced products and services of Permit Philly are provided to you when you visit PermitPhilly.com (the “Website” or the “Site”), use our Products (“Products”) or services, use our applications for mobile, or use software provided by Permit Philly in connection with any of the foregoing (collectively, “Permit Philly Services” or the “Services”). Permit Philly provides Permit Philly Services subject to the following conditions.By using Permit Philly Services in any manner, including but not limited to visiting or browsing the Site, you agree to be bound by this Agreement (the “Agreement”), including those additional terms, conditions, and policies referenced herein.If you do not agree to these terms, do not use Permit Philly Services or the Site. 

(1.) Definitions

(a.) Terms used with initial capital letters, and/or terms noted in quotation marks, will have the meanings specified – applicable to singular, plural, and descriptive forms – for all purposes of this Agreement; unless context clearly otherwise indicates.

(2.) Electronic Communications

(a.) When you use any Permit Philly Services, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by e-mail or by posting notices on this site or through the other Permit Philly Services. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.  

(3.) Payments, Taxes, and Refund Policy

(a.) You agree that you will pay the full amount agreed to if you retain PP through the Services, and that Permit Philly LLC may charge your payment method for any Products purchased and for any additional amounts (including any taxes or fees as applicable) that may be accrued by or in connection with use of Permit Philly Services.  You are responsible for the timely payment of all fees and for providing Permit Philly with a valid payment method for payment of all fees.

(b.) All costs associated with the retention of Permit Philly through the Services are final.

(c.) Prices for Products offered via Permit Philly Services may change at any time, and Permit Philly Services do not provide price protection or refunds in the event of a price reduction, promotional offering, or specialty pricing of individual Permit Philly Services determined by Permit Philly.  Permit Philly reserves the right to alter pricing of Permit Philly Services at any time for any reason.

(d.) Permit Philly uses Stripe, as well as bank transfers and checks, if you wish to pay in those ways.  If you pay Permit Philly using Stripe (via our invoicing software), you will use Stripe to finalize and pay for your order, and you will provide your credit card number directly to Stripe. Stripes’s privacy policy will apply to the information you provide.

(e.) If technical problems prevent or unreasonably delay service from Permit Philly in your case, your exclusive and sole remedy is a refund of the price paid, as determined by Permit Philly.

(f.) You are entitled to an automatic and full refund for the price of Permit Philly Services if and only if Permit Philly fails to do any work on your case after you have retained Permit Philly.

(g.) The determination of whether or not a given service has been fulfilled, whether or not Permit Philly has begun work on a given case, whether or not Permit Philly has completed a case, or any other concerns relating to the preceding Sections of this Agreement rests solely with Permit Philly.

(h.) For any refund claims not specifically addressed in Article 3 of this Agreement, Permit Philly reserves the right to determine whether or not to award a refund regardless of the reason for the refund request, and the amount of the refund if awarded.  

(4.) Right to Refuse

(a.) You acknowledge that Permit Philly reserves the right to refuse service to anyone at any time.  

(5.) Privacy

This privacy statement describes how Permit Philly collects and uses the personal information you provide on the Site.

(a.) We collect the following personal information from you at various stages of the purchasing process and/or throughout your use of Permit Philly Services as applicable:

  • Contact Information such as name, email address, mailing address, phone number
  • Unique Identifiers such as user name, account number, and password

(b.) While we currently offer payment only through PayPal, if Permit Philly at any time offers payment infrastructure on the Site, that payment infrastructure will also collect the following information from you:

  • Billing Information such as credit card number, and billing address
  • Financial Information such as bank account numbers

Even while using PayPal, Permit Philly reserves the right to collect and use this information with your consent as needed to process your order.

(c.) As is true of most Web sites, we may automatically gather information about your computer such as your IP address, browser type, referring/exit pages, and operating system. We may use this information to:

  • Send you requested Product or Service information
  • Respond to customer service requests
  • Administer your account
  • Send you marketing communications
  • Respond to your questions and concerns

(d.) If you provide Permit Philly personal information about others, or if others give us your information, Permit Philly will only use that information for the specific reason for which it was provided to us.  We do not sell or rent your personal information to third parties for promotional purposes.

(e.) We will share your personal information with third parties only in the ways that are described in this privacy statement. We do not sell your personal information to third parties.

(i.) We may provide your personal information to companies that provide services to help us with our business activities, such as printing and delivering architectural plans to you. These companies are authorized to use your personal information only as necessary to provide these services to us.

(ii.) We may also disclose your personal information…

  • as required by law such as to comply with a subpoena, or similar legal process;
  • when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request;
  • if Permit Philly is involved in a merger, acquisition, or sale of all or a portion of its assets – in such an event, you will be notified via email and/or a prominent notice on the Site of any change in ownership or uses of your personal information, as well as any choices you may have regarding your personal information
  • to any other third party with your prior consent to do so.

(f.) We may use cookies to, as one example, keep track of your preferences and profile information. Cookies are also used to collect general usage and volume statistical information that does not include personal information.

(g.) Our Site includes links to other Web sites whose privacy practices may differ from those of Permit Philly. If you submit personal information to any of those sites, that information is governed by the respective privacy statements of those sites. We encourage you to carefully read the privacy statement of any Web site you visit.

(h.) The Site may at any given time employ Widgets, which are interactive mini-programs that run on a website to provide specific services from another company (e.g. displaying the news, opinions, music, etc).  Personal information, such as your email address, may be collected through any Widget potentially used by the Site.  Cookies may also be set by such a Widget to enable it to function properly. Information collected by any Widget is governed by the privacy policy of the company that created it.

(i.) We may update this privacy statement to reflect changes to our information practices.  We encourage you to periodically review this section of the Agreement for the latest information on our privacy practices.  

(6.) Your Account

(a.) If you set up an account with Permit Philly, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. 

(7.) Copyright

(a.) All content included in or made available through any PP Service, such as text, graphics, logos, button icons, images, audio clips, digital downloads, and data compilations is the property of Permit Philly or its content suppliers and protected by both United States and international copyright laws.  Permit Philly’s trademarks and trade dress may not be used in connection with any product or service that is not the property of Permit Philly, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits Permit Philly.  The compilation of all content included in or made available through any PP Service is the exclusive property of Permit Philly and protected by U.S. and international copyright laws.

(b.) Permit Philly respects the intellectual property of others. If you believe that your work, or another’s work, has been copied in a way that constitutes copyright infringement, please contact us.  

(8.) License and Access

(a.) Subject to your compliance with the terms of this Agreement and your payment of any applicable fees, Permit Philly grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and make personal and non-commercial use of Permit Philly Services. This license does not include any resale or commercial use of Permit Philly Services, or its contents; any collection and use of any Product listings, descriptions, or prices; any derivative use of any PP Service or its contents; any downloading or copying of account information for the benefit of another merchant; or any use of data mining, robots, or similar data gathering and extraction tools.

(b.) You may not, and you will not encourage, assist or authorize any other person to copy, modify, reverse engineer, decompile or disassemble, or otherwise tamper with, the Permit Philly Services or the Site; whether in whole or in part, or create any derivative works from or of the Permit Philly Services or the Site.

(c.) All rights not expressly granted to you in this Agreement are reserved and retained by Permit Philly.  No Permit Philly Service, nor any part of any PP Service, may be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without express written consent of Permit Philly. You may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of Permit Philly without express written consent. You may not use any meta tags or any other “hidden text” utilizing Permit Philly’s name or trademarks without the express written consent of Permit Philly. You may not misuse the Permit Philly Services. You may use the Permit Philly Services only as permitted by law. The licenses granted by Permit Philly terminate if you do not comply with the terms of this Agreement.  

(9.) Other Businesses

(a.) Permit Philly may, from time to time, provide links to the sites of affiliated companies and certain other businesses. Permit Philly is not responsible for examining or evaluating, and we do not warrant the offerings of, any of these businesses or individuals or the content of their websites.  Permit Philly does not assume any responsibility or liability for the actions, product, and content of all these and any other third parties.  You should carefully review their privacy statements and other conditions of use. 

(10.) Legal Disclaimer

(a.) We reserve the right to disclose your personally identifiable information as required by law and when we believe that disclosure is necessary to protect our rights and/or comply with a judicial proceeding, court order, or legal process served on the Site.(b.) Permit Philly is not a law firm.  We do not give legal advice.  We offer procedural advice about the permit process in Philadelphia and project management generally, and may share stories of our experience with past administrative decisions of the City of Philadelphia; but we cannot and do not interpret the Philadelphia Code or any other law.  For cases that require a lawyer, we will hire a lawyer and refer to their judgment.  If you have concerns about the interpretation of the Philadelphia Code or any other legal document (including this Agreement), consult a legal professional. 

(11.) Applicable Law

(a.) By using any of the Permit Philly Services, you agree that the Federal Arbitration Act, applicable federal law, and the laws of the state of Pennsylvania, without regard to principles of conflict of laws, will govern these Conditions of Use and any dispute of any sort that might arise between you and Permit Philly. 

(12.) Site Policies, Modification, and Severability

(a.) Please review any other policies, such as our pricing models, posted on the Site. These policies also govern your use of Permit Philly Services. We reserve the right to make changes to the Site, policies, and these Conditions of Use at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.
